FCLC Member Benjamin Goldman Examines FTC Enforcement and Political Speech
In late 2024, two FTC commissioners outlined a program of antitrust and consumer protection law enforcement targeted at combatting perceived suppression of political speech. While the FTC’s investigation of Media Matters has encountered judicial resistance on First Amendment grounds, the FTC is expected to continue to initiate investigations of corporate entities for deplatforming individuals based on the political content of their speech. As described by the commissioners, this enforcement program will target a range of companies which the FTC views as suppressing political speech, from social media platforms to consumer financial service providers.
