Farewell to intended loss. And what else (and for how long)?
April 17, 2023 @ 12:00 pm - 5:00 pm
The Federal Criminal Law Committee for the Eastern District of Pennsylvania is pleased to announce its quarterly meeting and CLE program on Monday, April 17, 2023, at Noon. This event will be hosted and sponsored by Buchanan Ingersoll & Rooney PC, located at 50 S 16th St Suite 3200, Philadelphia, PA 19102. FCLC Member Jason P. Bologna, a Shareholder at Buchanan Ingersoll & Rooney PC, will moderate a panel discussion addressing recent changes in the law regarding proof of actual loss and its practical implications in defending White Collar cases, following the Third Circuit’s Banks decision.
The Third Circuit’s Banks decision jettisoning intended loss was a welcome application of earlier rulings giving Guidelines commentary a serious demotion. Putting it to work for your clients requires understanding where it came from, what else is in the crosshairs—and what may take it all away. Is this a short-lived victory, a paradigm shift, or maybe both? Join us to hear from practitioners who have litigated these issues both pre- and post-Banks, and for an update on the Sentencing Commission’s response.
The panel will include:
- Jason P. Bologna, Shareholder at Buchanan Ingersoll & Rooney PC (Moderator)
- Hope C. Lefeber, Hope C. Lefeber Law Offices
- Lisa Mathewson, Principal at Mathewson Law LLC
One hour of CLE credit will be provided, with accreditation in Pennsylvania, New Jersey, and New York.
